Case Study:

The renowned leader of a prominent Native American tribe member hired a contractor to build a high-end custom home on tribal lands. The resulting engineered log cabin structure was not yet complete when it became obvious that there were numerous problems.

SHCC was retained to thoroughly investigate and document the issues. Through a combination of extensive visual inspection and limited destructive testing, it became obvious that even very basic construction standards were not followed by the contractor.

Working closely with the client’s legal team, SHCC was able to help find the most cost effective solution for that project. After years of paying for an uninhabitable dream home that turned into a nightmare, our clients were finally made whole, and were thus able to move on with their lives.

While every situation is unique, SHCC can assist you with the following 3-step process.

Step 1 - Investigation:

  • Thoroughly inspect the entire project including interior, exterior and roof. Document any abnormalities or defective conditions discovered. Roof can be inspected by drone to avoid damaging the roof surface. Compare completed components to plans, building department records and previous real estate listings. Provide testing services as necessary to determine “point of failure” when necessary.
  • Document all findings with field observation notes and photos. Develop photo database and include any owner or contractor supplied photos that may show defective conditions found during repairs.

Step 2 - Analysis:

  •  Review all documents related to the project including plans, changes to the plans, and inspection records. Check for change order signatures, lien releases, subcontractor invoices, material supplier releases and delivery dates.
  •  Investigate all contractors involved for proper license, insurance and Workmen's Compensation insurance proof.
  • Produce report with all findings including any improper actions regarding real estate contracts, unpermitted additions or alterations, contractors license law violations (CSLB & Civil Code) and Contractor standard of care issues.
  • Produce a cost of repair based on verifiable building repair costs and/or get bids from prequalified contractors for remediation.
  • Work with Homeowner’s attorney (and assist in selecting one if necessary) to protect the Homeowner's interests and right to recovery.
  • Appear at Mediation, Arbitration Hearing or Trial to assist in recovery for losses.

Step 3 - Remediation & Repairs:

  • SHCC will serve as a construction project manager overseeing the entire remediation and repair process on your behalf.
  • Potential repair contractors will be evaluated based on their relevant experience, track record and verifiable references before being invited to the bidding process.
  • Repairs will be closely monitored and applications for payment thoroughly vetted throughout until repairs are completed to your satisfaction.
